Will the CO2 tax bring more climate protection?

Faced with rising rents and the current high energy prices, it is only a matter of time before the debate about limits in residential housing climate protection comes to a head. Clearly climate protection does not come for free. However, often this quickly gives way to the question of who is going to pay for it. The debate over whether tenants or landlords should pay the additional costs is understandable, but fails to get to the heart of the matter. This is also shown by the findings of a recent tenant study conducted for us by Professor Pfnür of Darmstadt Technical University.

Carbon pricing and CO₂ cost allocation in the buildings sector: the Carbon Dioxide Cost Sharing Act

The discussion to introduce CO2 pricing for the building sector in Germany ran for several years at specialist level before politicians took up the idea and put it into practice. The German government's "Climate Protection Program 2030 for the Implementation of the Climate Protection Plan" stipulates that Germany should emit 55 percent fewer greenhouse gases by 2030. To achieve this, CO2 emissions are to be reduced across all sectors. Various laws are paving the way for this, such as the CO2 Cost Sharing Act, which is the focus of the following section.

On May 5 2023 the digital version of Berliner Energietage came to a successful end. More than 60 events took place over the three days of the online congress. In the panel discussion “Digital Control: Housing Companies and Tenant Households Working Together for the Heat Transition in Existing Buildings”, Dr. Dirk Then, CEO of the noventic group, together with Dr. Christian Osthus, General Counsel (Justiziar) at the IVD Federal Association, Ralf Michels, Member of the Executive Committee of the VDIV and Professor Kunibert Lennerts, Professor of Facility Management at the Karlsruhe Institute of Technology (KIT), looked into the role of residents in climate protection in the housing industry and how to involve them in the heating transition.

noventic study: the role of the tenant in climate protection in residential housing.

Climate protection in the building sector needs quick successes. A study commissioned by the noventic group on the role of tenants in climate protection shows that tenants are willing to make greater climate protection efforts within their own four walls, provided the cost, convenience and simplicity are right. To achieve rapid CO2 savings, the 1,000 tenant households surveyed showed a high level of acceptance of both the automation of heating and hot water supply and sharing of their own consumption data.

If an investor is unable to realise a return because he does not receive repayment from the beneficiary of his investment for the newly created benefit, this is known as the investor-user dilemma. The legal requirements to modernise the energy efficiency of residential buildings in order to achieve the German government's climate targets by 2050 are a recurring problem. This is why the term landlord-tenant dilemma is also used in this context.

Experts and industry stakeholders alike agree that there is huge potential for energy savings in the existing building stock. However, without the professional housing industry the energy and heating transition cannot succeed. To date, though, real estate has lagged dramatically behind on the decarbonisation front, and much greater efforts will be needed to achieve the goal set by politicians of reducing all CO2 emissions to net zero by 2045 in Germany and by 2050 in Europe.

Everything happened very quickly: In October, Economics Minister Robert Habeck announced a planned amendment to the Metering Point Operation Act, and in early December the media reported the first details of the Federal Economics Ministry's "Act to Restart the Digitalisation of the Energy Turnaround". The resumption of the digitisation of the energy transition thus appears to be within reach. Processes relating to smart meters are to be made less bureaucratic, much simpler and more cost-effective for consumers.
